One particular and climactic highlight of 'Stop making Sense' came when the band took Al Green’s TAKE ME TO THE RIVER farther and deeper than ever imaginable – first an enormous boom-boom from Chris Frantz, then the doubled bass (Busta Jones and Tina) making the earth move, next the Baptist choir chanting of the title by Nona Hendryx and Dolette McDonald (the crowd was roaring), and finally "I don't know why I love you like I do."

They warned me your childhood would whizz by in a flash

They warned me and I laughed,

because then,

each day felt like a lifetime.

Each sleepless night was a year, each hour of the day was an age.

All my energy was consumed, with keeping you alive, happy, thriving.

Your smiles became my goal, your laughter my reward, your tears my every waking concern.

And here we are my love, you have grown.

I remember all the firsts, but I have no idea when the ‘lasts’ happened...

Where was I?

The last time you snuggled into my lap to read.

The last time I lifted your warm little body to mould into mine, that fit, just right.

The last time you crawled into my safe space, in the dark of the night.

They warned me your childhood would whizz by in a flash,

And I laughed.

But it did, my love,

It did.

And now I watch you grow evermore strong and I vow to drink in every tiny detail,

lest that go by in an instant also.

I may not remember all the ‘lasts’ my little one,

But I am watching for every ‘new’.

Trump’s Last Attempt to Steal the Election Won’t Work

Joe Biden has won. He will be our next president. 

Normally, the loser of the race would give a gracious concession speech, and accept the results. 

That won’t happen this time around, because Donald Trump is a pathological narcissist who will never admit defeat. But there’s no legal requirement for the losing candidate to formally concede - it’s just another tradition Trump will choose to ignore. 

He can bluster and protest all he wants, but like it or not, the Constitution and federal law establish a clear timeline of how electoral votes are processed, and when the new president takes office. Here’s how that process normally plays out, how Trump might try to undermine it, and why he is unlikely to succeed.

The first date to look out for is December 8th. After Election Day, states have until this date, called the “safe harbor” deadline, to resolve any election disputes. Each state has a unique process outlined in its state constitution for this, and the federal deadline was created so that state electoral disputes don’t drag on endlessly.

Next is December 14th. This is when the electors meet in their states, and cast paper ballots for president and vice president. And then governors certify the electors’ votes. 

The governor sends these certified results to Congress by December 23rd.

On January 6th, 2021, the newly sworn-in Congress meets in a joint session to officially accept each state’s Electoral College votes and count them. This is normally a ceremonial event in which the already-settled results of the election are simply made official. This is when the presidential race formally ends.

Lastly, on January 20th, the president and vice president are inaugurated.

Normally, no one pays much attention to this process before Inauguration Day because it goes off without a hitch. But we’ve seen that Trump will do anything to hold onto power. It’s important to know how and when he might try to undermine this process, and also understand how unlikely it is he’ll succeed. 

Trump backers are trying to push Republican-controlled state legislatures to appoint their own slates of Trump electors. That’s why the campaign has launched empty legal challenges to perfectly normal vote counts – trying to sow enough doubt to give the state legislatures political cover to appoint their own electors. 

This isn’t likely to happen. It would be challenged as an unconstitutional power grab, since state legislatures have almost always deferred to the results of the state’s popular vote in assigning electoral votes. And not to mention, it would spark massive public outrage.

Thankfully, it doesn’t look like Republican legislators in any of the key swing states want to expend their political capital defending a failed president, and some have even explicitly come out against this plan.

All this is to say, be patient, keep the faith, and don’t fall into Trump’s cry for attention. We must see this for what it is: A final attempt of a desperate, bitter man to cling to power. 

Joe Biden will be our next president.

The Supreme Court Goes Rogue

An older generation remembers President Richard Nixon desperately insisting, during the Watergate scandal, “I am not a crook.” Along the same lines,

Let’s go back to the year 2000 and the Bush versus Gore presidential contest. The hyper-close election came down to Florida where, at a key moment with a recount underway, Bush enjoyed a threadbare lead of 537 votes out of 5.8 million cast. Bush’s margin had been shrinking as the recount progressed, and Democrats were hopeful it would disappear. Enter the right-wing Supreme Court. In a startling 5-4 decision, the court halted the recount, handing the presidency to Bush. The decision was roundly condemned by nearly 700 law professors of different political views, who warned: “By stopping the vote count in Florida, the U.S. Supreme Court used its power to act as political partisans, not judges of a court of law. By taking power from the voters, the Supreme Court has tarnished its own legitimacy.” (Disclosure: I drafted the statement!) Why did the court perpetrate this judicial coup d’etat on behalf of a candidate who’d lost the national popular vote by over a half million ballots? Because it was necessary to secure the succession. In 2000, the right wing dominated the Supreme Court, but just barely. With two justices in their 70s, the five conservatives feared a Democratic president would be able to shift the balance to the liberal justices. So the conservatives installed an illegitimate president and in return received two illegitimate right-wing justices, John Roberts and Samuel Alito. The right-wingers used their continued ascendancy to enact the GOP’s political agenda. Defying long precedent, they invented a personal right to own firearms in the 5-4 D.C. v. Heller case, enabling a seemingly unstoppable epidemic of gun violence. In the 5-4 Citizens United decision, they emboldened corporations and the rich to corrupt our politics with floods of money. And in the 5-4 Shelby County case, they unleashed a war on democracy by crippling the Voting Rights Act. Now add Justice Neil Gorsuch. In February 2016, conservative Justice Antonin Scalia died. Under the Constitution, President Obama had the right and obligation to fill the vacancy — and the Senate had the duty to consider his nominee, Merrick Garland. Instead, the GOP-controlled Senate spurned its constitutional obligations, refusing to even hold a vote on Garland’s confirmation. Over a year later, Donald Trump — another Republican president who took office after losing the popular vote — gained the presidency and appointed Gorsuch, who stole the seat that was Obama’s to fill under the Constitution. If these three had not been placed on the court through chicanery, we’d have a liberal majority instead of a right-wing supermajority — and we’d see major differences in our lives. We’d get better solutions to school shootings than putting bullet-proof backpacks on our children. The crushing burden of student loans would be lightened for millions. Our democracy would be less at risk, with voting rights protected and gerrymandering reined in.

Just Do It: Advice for Young Friends

A few weeks ago, a friend of mine mentioned she was about to begin her last year as a twenty-something; 30 would be upon her before she knew it. She went on to list 50 things she wants to accomplish in the coming year – many of which involve money and her art (she is a wonderful actress). It is an ambitious list. I wished her luck, and gave her a few words of advice. Since then I’ve been thinking about what I said, and realized I needed to add some more – both for her and for my other young friends, many of whom are artists of one type or another.

If I can give you one piece of advice: DO IT! Do everything on your list! Don’t wait around thinking there will be a better time to start. There won’t be. There is only time, and it goes a lot faster than you realize. Before you know it, you’ll be 30. You’ll go from 30 to 40 in about 10 minutes. And, from 40 to 50 even faster. Albert Einstein, Stephen Hawking, or Neil deGrasse Tyson might argue with me, but time really does speed up as you get older.

When I was your age, I thought 30 was old, and that I’d never get there. Hell, there were a few days when I was in the Army, I didn’t think I’d make it to 22. Now, I’m 45 and there’s very little I wouldn’t trade to go back to 25 knowing what I know now.

I wish I could make you understand me. I know you don’t. You can’t. This is not an insult. It’s just the way life works. You don’t know what you don’t know until years down the road. I was young. I had plans, and I didn’t want to listen to “old” people. I had all the answers. I know so much more now.

One of the most important things I’ve learned about life is that it doesn’t mean shit. In a hundred years, you’ll be dead, and very little of this will matter. What people think of you now or then won’t mean a damned thing. Sure, you might change the world; bring about peace in the Middle East; cure cancer; win a dozen awards – but it won’t affect how your private life is judged.

Whether you graduated first in your class at Harvard, or at the bottom of a community college; if you’re buttoned-down and conservative, or you get caught running naked through Times Square; even if your ex- posts your “No, Baby, I swear I’m the only one who’ll ever see it” sex tape on-line; it might rate a line or two in your Wikipedia entry, and that’s it. And, if you’re dead – and if everyone you know, and who judged you, is dead too – what will you care?

Too many people in this world give a shit about things that don’t matter a bit, especially other people’s business. I figure, if you’re not hurting someone else, and what you’re doing works for you, fuck what other people think. It took me a long time to develop that attitude.

You have to do what makes you happy. Do it your way, but do it. Sing your song. If people don’t like it, fuck ‘em. You’re on your journey, not theirs. You have to do what you can with the time you’ve got.

But, remember, it’s also important to stop and look at the world around you once in a while, to sit down and relax; take your bearings, and make sure you’re on the right path. I should say, make sure you’re on the right path for you!

It’s OK to be a waitress, or a tire salesman, or a security guard, as long as you’re also working toward what you love. If you have five minutes, sit down and read the trade papers, or scribble down the words banging around in your head.

Wayne Gretzky says, “You miss 100 percent of the shots you don’t take.” That applies to everything in life. 100 percent of the sonnets you don’t submit get rejected. You’re passed over for 100 percent of the parts you don’t audition for. You don’t get 100 percent of the raises you don’t ask for. The worst anybody can say is no.

Now, I’m not saying you’re automatically entitled to anything. This is life. It’s not fair. The world doesn’t owe you shit; not money, not love, not happiness, not success. You have to work for what you want, and keep at it. And, in the end, it may get you nowhere. But, if you don’t go after what you want, you’ll end up nowhere anyway. You pays your dollar, and you takes your chances!

Oh, and one more thing: Don’t spend too much time sitting around, listening to old men – like me – spout off about what you should be doing. There is no instruction book for life, and most people who claim to have things figured out are faking it, just like the rest of us.

At fifty you can no longer bear the constraints. You can't stand the too-tight bra, the forced dinners with the sister-in-law who checks your dust in the corners, high heels and circumcising smiles.

At fifty you have no desire to prove anything. You are what you are: the things you've done and the things you still want to do. If others like it, fine, otherwise, it's the same.

At fifty it doesn't matter if you had children or not. You will be the mother anyway: of your mother, of your father, of an aunt left alone, of your dog or of a stray cat that you picked up from the street. And if all this is not there, you will be your own mother.

Because over the years you will be taught to take care of a body that you finally love, becoming more and more imperfect only in the eyes of others. Who cares if half the closet is the wrong size? The important thing is that your back does not creak too much when you stand up.

At fifty you want freedom. Free to say no, free to stay in your pajamas all Sunday, free to feel beautiful for yourself and not for others. Free to go it alone: those who love you will stay at your pace, those who don't care about others, at theirs. You are free to sing loudly in the car even if people glare at you at traffic lights.

You will have dreams like when you were in your twenties and you will ask every god for time to make them come true again. And now, just when you have eaten half of your life, in the hustle and bustle, you will find the desire to slowly taste the sugar and salt of the days that await you.
