Since I’m Thinking About This Instead Of Studying For Bar Prep:

since I’m thinking about this instead of studying for bar prep:

people in general tend to assume that a person who’s been arrested is either innocent or guilty. and if they’re guilty, then they deserve fewer rights than the innocent person.

like, if the police break into an innocent person’s house and look for drugs, we recognize that it’s a bad thing and a gross violation of rights. but if the police break into someone’s house and do find drugs, well, that’s just what they deserved. we’d all be upset if the police started randomly murdering people on the street for no reason, but many wouldn’t mind if the police started randomly killing known child molesters. it’s not okay if the police plant evidence to frame an innocent man for murder, but if they know he’s the murderer and plant evidence to help the case along? well, that’s unfortunate but necessary.

there are three problems with this:

You cannot always know with certainty who’s innocent and who’s guilty;

A two-tiered “innocent” and “guilty” legal structure will always be used against innocent marginalized people;

Even guilty people have rights.

this happens a lot on tumblr. not exclusively on tumblr (it’s also a major aspect of most “gritty” police dramas and almost all comics), but it’s definitely there. like, calls to summarily execute rapists sound great in theory, because we all agree that rape is evil. except for when it’s used to kill innocent black men who looked the wrong way at a white woman.

and there are people who will say that no, of course, the problem isn’t summarily killing rapists, the problem is summarily killing the wrong people (that is, innocent people). which, again, you can’t know who’s innocent and who’s guilty - lots of innocent people aren’t sweet old ladies who’ve never done anything wrong, or have perfect alibis and never contradict themselves. hell, being guilty of a crime in the past doesn’t mean that they committed this specific crime that they’ve been accused of.

and even if they are guilty - even if they are stone-cold, unrepentantly guilty - they still have rights. that’s what “innocent until proven guilty” means. it means that stripping someone of their legal rights is a big fucking deal, so no matter how guilty Obvious McCriminal looks, you still have to follow the rules we’ve set in place to prevent abuses.

like, it’s not that every person who’s ever been treated shittily by police and the court system is actually innocent, so therefore the system is bad. it’s that we have a system that treats people like shit once we’ve decided they’re guilty, regardless of when the decision is made, and we’re okay with that. after conviction? definitely. after arrest? yup. before arrest, because we just have a feeling about them? sure.

and I get why people make posts or write stories about guilty people being treated badly. wanting vengeance is a powerful emotion. grief and anger are powerful emotions. it is not unnatural to want to hurt people who have hurt others. people like the idea of karma, of cosmic scales balancing out the hurt and suffering inflicted by a person by making them suffer back. I’m not saying that no one is allowed to have those feelings.

I’m just saying that there are implications behind them that are deeply disturbing (“if I decide you’re guilty, you’re less of a person to me”) and that it’s the primary driving force behind most of the issues in our criminal justice system.

…I almost killed myself

I put on my sunglasses, to hide my swollen eyes, over my tears. I cried all my makeup off. Went inside to have a milkshake. I don’t know why. I wanted something to drink as I figured out what I would do. I got a soda and a milkshake. Medium. The cashier looked at me and with a line around the corner of the counter he rushed away from the counter “Hold on “ he yelled to a coworker.

I filled my soda and went back and saw him looking all over. I go up and he gets close and says “I made it a large”.

That was seriously enough for me not to do it. His kindness. Someone went out of their way and as I went back in my car to cry I realized I could muster through a few other days. A few more weeks. Then I came down from that panicky high of anxiety, depression, and pain. I finished my shake. And it was enough time to let me feel better. I… I’m alive. I’ll make it through.

Try and be nice today. Tomorrow. Something as much as a smile. It helped so much.

Thank you man at McDonalds.

The milkshake saved my life

I like to imagine that as he gets older, Riz stress bakes. Especially when he's stuck on a case, he pulls out a cookbook and starts making cookies and muffins and cakes. He like measuring out the precise amounts and having control over something and getting things to come out perfectly every time (because baking is a science) helps relax him from spiraling. He learned from Adaine. She learned from Jawbone and since Riz refuses to seek therapy, Adaine passes along Jawbone's tips in her own secret way to make sure Riz doesn't go crazy. So when the Bad Kids suddenly get a knock ont he door only to find plate after plate of baked good wrapped in plastic sitting on their porch they know someone needs to go do a wellness check on Riz.

That’s still a lot of trees #EthicalMemes

listen I don't think this is where I'm going with the main fic of the au so I feel fine sharing it.

I need y'all to know that there is a version of Aasimar au junior year in my head where one night Kristen and Riz have a very sincere conversation about Riz's fear of being left alone and where Kristen basically says "I know you're really worried about this, but I am not going anywhere and you're not getting rid of me. and I promise that as long as you stick around with me I'll stick around with you" and they do a whole pinky promise and everything because they are dorks.

and then the next morning Kristen wakes up and "oh huh that's weird I've never felt this spell before I wonder what it does" and she accidentally Eldritch Blasts herself. turns out that making a very sincere promise to your aasimar paladin friend who you have an extremely devoted friendship with is an EXCELLENT way to accidentally take a level of Celestial Warlock.

Kristen is absolutely delighted by this. Riz is losing his shit because "KRISTEN I ACCIDENTALLY STOLE YOUR SOUL, WHAT IF I MESS IT UP???!! KRISTEN STOP ELDRITCH BLASTING THINGS AND FOCUS". the rest of the Bad Kids think this is the funniest thing that has ever happened

WHAT TO DO AT AN ICE CHECKPOINT, ESPECIALLY IF YOU’RE A WHITE CITIZEN

(please, please, please copy, paste, and share widely):

-Border Patrol can verify citizenship within 100 miles of a border or “external boundary.” This includes coastlines so NYC is within the 100-mile zone.

-Border patrol can only ask brief questions about citizenship, and they cannot hold you for an extended time without cause.

-You always have the right to remain silent. You do not need to answer their questions.

-***WITH THAT SAID, IF YOU ARE A BORN CITIZEN OF THE UNITED STATES AND ESPECIALLY IF YOU ARE WHITE, YOU NEED TO SPEAK THE FUCK UP.***

-The most important acts of resistance are the small ones. Make it difficult and uncomfortable for ICE agents to do their jobs. They are counting on citizens to turn a blind eye and allow them to deport undocumented citizens without challenge. Disabuse of that notion.

-If you are on a train, bus, or anything else and ICE or CBP boards, you need to stand up and loudly let everyone know that they have the right to remain silent or only answer questions in the presence of an attorney, no matter their citizenship or immigration status. There have been numerous reports that confronting the agents in this way has caused them to leave without verifying citizenship. THIS CAN SAVE LIVES.

-If you see anyone being held up by immigration, loudly ask if they are being detained and if they are free to go.

-Immigration officers cannot detain anyone without reasonable suspicion, an agent must have specific facts about you that make it reasonable to believe you are committing or committed, a violation of immigration law or federal law.

If an agent detains you, you can ask for their basis for reasonable suspicion, and they should tell you.

-Always say no to a search and let everyone know that they can and should refuse consent to a search.

-They cannot search or arrest anyone without facts about that make it probable that they are committing, or committed, a violation of immigration law or federal law.

-Silence alone meets neither of these standards. Nor does race or ethnicity alone suffice for either probable cause or reasonable suspicion

-As white citizens, we have a level of privilege which protects us from retaliation from ICE for being “rude” and making a scene, which makes it our DUTY to speak up and make sure people without the same privilege know their rights. GET LOUD. YELL. YELL IN SPANISH IF YOU KNOW IT. LET PEOPLE KNOW THEY DON’T HAVE TO SAY SHIT. MAKE ICE UNCOMFORTABLE. THROW SAND IN THE GEARS OF WHITE SUPREMACY.

BONUS INFO:

-It is perfectly legal to record immigration agents as long as you are not on government property or at a port of entry. If your train/bus gets board, pull your phone out and start videotaping immediately.

-If you are detained or see someone getting detained, get the agent’s name, number, and any other identifying information. Get it on tape.

-Contact the ACLU if you see someone’s rights being violated.
